ข้อตกลงและเงื่อนไขการใช้บริการ
เงื่อนไขและข้อตกลงเหล่านี้ ถือว่าเป็นอันเข้าใจกันดีและมีความเข้าใจตรงกันทั้งสองฝ่าย ระหว่าง ทางเรา Fast Commerz (ผู้ให้บริการ) และทางท่าน (ผู้ใช้บริการ) ซึ่งจะต้องยอมรับเงื่อนไขและปฏิบัติตามกฎระเบียบที่กำหนดไว้อย่างเคร่งครัด โดยมีรายละเอียดดังนี้
ข้อ 1. ผู้ให้บริการขอสงวนสิทธิ์ที่จะไม่ให้บริการ หรือระงับการให้บริการของผู้ใช้บริการทันที โดยมิต้องแจ้งให้ทราบล่วงหน้า และจะไม่มีการคืนเงินค่าบริการ ถ้าผู้ใช้บริการมีการกระทำที่ขัดต่อนโยบายการใช้บริการในลักษณะดังต่อไปนี้ และผู้ให้บริการขอสงวนสิทธิ์ในการเป็นผู้พิจารณาว่าสิ่งที่ผู้ใช้บริการกระทำนั้นเป็นการผิดกฎระเบียบข้อบังคับหรือไม่
ข้อ 2.การกระทำใดๆ ของผู้ใช้บริการที่เกี่ยวกับการเผยแพร่ไม่ว่าจะทำในรูปแบบใด ให้ถือเป็นการกระทำที่อยู่ภายใต้ความรับผิดชอบของผู้ใช้บริการแต่เพียงผู้เดียว ผู้ให้บริการไม่มีส่วนเกี่ยวข้องใดๆ ทั้งสิ้น
ข้อ 3.การใช้บริการ จะต้องมีวัตถุประสงค์ที่ชอบด้วยกฎหมายเท่านั้น และจะต้องไม่ใช้ส่งเสริมหรือสนับสนุนต่อการกระทำหรือกิจกรรมใดที่เป็นการไม่ชอบด้วยกฎมาย การใช้บริการจะต้องเป็นการใช้เกี่ยวกับธุรกิจ การค้า ซึ่งไม่ผิดต่อกฎหมายหรือระเบียบใด ๆ ถือเป็นการต้องห้าม ในกรณีที่มีการกระทำดังกล่าวเกิดขึ้น ผู้ใช้บริการซึ่งได้กระทำการเช่นว่านั้น จะต้องชดใช้ค่าเสียหายต่าง ๆ ที่เกิดขึ้นแก่ผู้ให้บริการ หรือผู้ที่ได้รับความเสียหายนั้นทั้งสิ้น ผู้ใช้บริการยอมรับว่าหากถูกบุคคลอื่นฟ้องร้องหรือกล่าวหาว่ากระทำผิดกฎหมาย หรือกระทำละเมิดต่อบุคคลอื่น อันเนื่องมาจากการใช้บริการ ผู้ใช้บริการจะปกป้องและคุ้มครองผู้ให้บริการ ไม่ให้รับผิดต่อบุคคลอื่นนั้น ไม่ว่ากรณีใด ๆ ทั้งสิ้น
ข้อ 4. ข้อมูลที่ผู้ใช้บริการให้กับผู้ให้บริการ ต้องเป็นข้อมูลที่เป็นจริงและถูกต้อง หากผู้ใช้บริการป้อนข้อมูลไม่ถูกต้องหรือข้อมูลมั่วเข้ามา ผู้ให้บริการจะไม่จัดทำตามคำขอ
ข้อ 5.ผู้ให้บริการมีสิทธิ์ที่จะเข้าตรวจสอบระบบ หากมีปัญหาเกี่ยวกับความปลอดภัยของระบบที่อาจจะเป็นผลกระทบกับความปลอดภัยของระบบของผู้ให้บริการ หรือลูกค้ารายอื่น ผู้ให้บริการมีสิทธิ์ที่จะเก็บ วิเคราะห์ หรือนำสถิติการใช้ข้อมูลที่เกิดจากการใช้บริการไปใช้โดยไม่ต้องขออนุญาตจากผู้ใช้บริการก่อน
ข้อ 6.ผู้ใช้บริการจะต้องชำระค่าใช้บริการตามที่ระบุไว้ในใบสั่งซื้อ หากไม่ชำระภายในระยะเวลาที่กำหนด จะถือว่าบัญชีของผู้ใช้บริการขาดการต่ออายุ บัญชีที่ขาดการต่ออายุ อาจถูกระงับการให้บริการชั่วคราว การระงับการให้บริการนี้ไม่ทำให้ผู้ใช้บริการพ้นพันธะในการจ่ายค่าบริการ
ข้อ 7.กรณีที่ผู้ใช้บริการผิดนัดไม่ชำระค่าธรรมเนียมหรือบริการใด ๆ ตามกำหนด ผู้ให้บริการมีสิทธิ์ที่จะระงับการให้บริการ โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า
ข้อ 8.ผู้ให้บริการมีสิทธิ์ที่จะปฏิเสธการขอเป็นสมาชิกของผู้ใช้บริการ และทรงสิทธิ์ที่จะยกเลิกการเป็นสมาชิกของผู้ละเมิดหรือพยายามละเมิดเงื่อนไข กฎเกณฑ์การใช้บริการ ได้โดยไม่ต้องแจ้งล่วงหน้า ในกรณีผู้ให้บริการบอกเลิกการเป็นสมาชิกผู้ใช้บริการด้วยสาเหตุดังกล่าว ผู้ให้บริการมีสิทธิ์รับเงินมัดจำหรือเงินประกันหรือเงินจำนวนใดๆ ที่ได้รับชำระมาล่วงหน้าได้ทั้งหมดทันที
ข้อ 9.หากผู้ใช้บริการประสงค์จะยกเลิกการใช้บริการต้องแจ้งให้ผู้ให้บริการทราบเป็นลายลักษณ์อักษรล่วงหน้าอย่างน้อย 7 วัน การให้บริการจะสิ้นสุดลง เมื่อผู้ใช้บริการและผู้ให้บริการหรือฝ่ายใดฝ่ายหนึ่งบอกยกเลิกการใช้บริการ
ข้อ 10.เมื่อมีการยกเลิกการใช้บริการ ผู้ให้บริการมีสิทธิ์ลบข้อมูลของผู้ใช้บริการซึ่งฝากไว้ในระบบของผู้ให้บริการทั้งหมดทันที
ข้อ 11. ผู้ใช้บริการสัญญาว่าจะปฏิบัติตามเงื่อนไข กฎ ระเบียบ คำแนะนำที่ผู้ให้บริการกำหนดขึ้น เพื่อให้สอดคล้องกับนโยบายของผู้ให้บริการและที่จะกำหนดต่อมาในอนาคต กรณีที่ผู้ใช้บริการผิดเงื่อนไขข้อหนึ่งข้อใด ผู้ให้บริการมีสิทธิ์งดให้บริการแก่ผู้ใช้บริการได้ทันที
ข้อ 12.ผู้ใช้บริการต้องเข้ามาตรวจสอบหรือติดตามข่าวความเคลื่อนไหวต่างๆ ที่เว็บไซต์ของผู้ให้บริการ อย่างน้อยที่สุดเดือนละ 1 ครั้ง เพื่อรับทราบโปรโมชั่นพิเศษและข่าวสารที่เป็นประโยชน์อื่นๆ
ข้อ 13.ผู้ให้บริการ ขอสงวนสิทธิ์ในการระงับการให้บริการชั่วคราว ในกรณีที่ท่านใช้พื้นที่เกิน Quota หรือ สิ้นสุดสัญญาการใช้บริการ โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้าแต่อย่างใด รวมถึงผู้ให้บริการมีสิทธิ์ในการปรับ เปลี่ยน แก้ไข แพคเกจ โดยที่ไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า
ข้อ 14.หากเกิดกรณีพิพาทใดๆ ขึ้น ผู้ใช้บริการที่เกี่ยวข้อง รวมถึงผู้ให้บริการ จะต้องให้ความร่วมมือในการสืบสวนสอบสวนของเจ้าหน้าที่ที่มีอำนาจในการสอบสวน
ข้อ 15.ข้อมูลเนื้อหา และการออกแบบต่างๆที่ ผู้ให้บริการเป็นผู้จัดทำขึ้น ผู้ให้บริการขอสงวนลิขสิทธิ์ห้ามมิให้ ผู้ใช้บริการคัดลอก ทำซ้ำหรือ นำไปใช้ที่อื่น โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษร
ข้อ 16.ผู้ให้บริการขอสงวนสิทธิ์ในการเปลี่ยนแปลงข้อตกลงในการให้บริการนี้ได้ตลอดเวลา โดยไม่ต้องแจ้งให้ผู้ใช้บริการทราบล่วงหน้า
ข้อตกลงและเงื่อนไขเหล่านี้มีผลบังคับใช้ทันที เมื่อผู้ใช้บริการตัดสินใจและเปิดใช้บริการโดยอ้างอิงจากข้อมูลในระบบของ Fast Commerz เป็นสำคัญ โดยให้ถือว่าผู้ใช้บริการตกลงยินยอมปฏิบัติตามข้อกำหนดทั้งหมดนี้แล้ว ทางผู้ให้บริการมีสิทธิ์ที่จะปฏิเสธ และ/หรือ ยกเลิกการให้บริการกับผู้ใช้บริการ โดยไม่ต้องแจ้งให้ทราบล่วงหน้า ผู้ให้บริการ ขอสงวนสิทธิ์ที่จะบอกเลิกสัญญาโดยไม่มีการคืนค่าบริการใดๆ ทั้งสิ้น ถ้าผู้ใช้บริการ มีการกระทำที่ขัดต่อนโยบาย และข้อตกลง ในการให้บริการดังที่กล่าวมาข้างต้น และหากเกิดกรณีพิพาทไม่ว่าเรื่องใดๆ ก็ตาม คำตัดสินของผู้ให้บริการถือเป็นที่สิ้นสุด และหากมีการดำเนินคดีตามกฎหมายใดๆ ผู้ใช้บริการต้องรับผิดชอบค่าใช้จ่ายในการดำเนินการทางกฎหมายในส่วนของผู้ให้บริการในทุกขั้นตอน
Terms and Conditions of “Fast Commerz” Services
All terms and conditions of the “Service(s)” in this Site are deemed as being mutually well and accurate understood between “Service Provider” (Fast Commerz) and Service Receiver” (Customer) having to agree the conditions and strictly abide by regulations as provided according to the following terms:
1. The Service Provider reserves the right to refuse or suspend the Service to the Service Receiver immediately without advance notification, and will not refund Service cost unless the Service Receiver does not take any of the following actions and violate against the Service Policies with respect to Sale Page in any manner that: and the Service Provider reserves the right in its sole discretion to take into consideration on whether such action is deemed as violation or not.
1.1 is unlawful, threatening, defamatory, insecure to the nation, royal institution, religion and other persons, including any activity violates against all applicable laws.
1.2 is obscene, pornographic or likely to be obscenity, pornography, lewdness and prostitution including websites linked thereto.
1.3 is relating to any type of gambling namely betting or online betting ect.
1.4 is exploited in any type such as online streaming, Download, MP3, Software, VDO & Voice Clips, Music Online irrespective of whether those are legitimate or not, including effort to avoid in the form of any filename extension.
1.5 infringes someone else's patent, trademark, trade secret, copyright or other intellectual property or other rights.
1.6 is threatening and deceptive in any way, gives any false information and disseminates any indecency or narcotic.
1.7 violates against the law on Thailand’s Computer-related Crime Act 2017.
1.8 is injurious to the Service Provider’s reputation or is contrary to good morals including other cases similar to the aforementioned are deemed unsuitable by the Service Provider.
2. Any of actions relating to the dissemination regardless of any form taken by the Service Receiver is under his/her own responsibility. The Service Provider is not responsible for such action.
3. The objective of the use of the Service is to be legal and does not support or encourage any of unlawful actions or activities. In case of using the Service through illicit commerce or business, the Service Receiver is bound to compensate for all of damages resulted from his/her actions to the Service Provider or injured persons. The Service Provider agrees and acknowledges in protecting the Service Receiver from those who file a lawsuit for any damage due to the use of the Service in any way.
4. The content or information provided by the Service Receiver to the Service Provider must be true and accurate. If the Service Receiver enters inaccurate or false information, the Service Provider does not proceed to input such information herein.
5. The Service Provider has the right to inspect the system hereof. In the event that the problem with respect to the security system hereof has an impact on the Service Receiver or someone’s systematic security, the Service Provider has the right to collect, analyse or take statistics derived from the Service for exploitation without the Service Receiver’s permission.
6. The Service Receiver is required to pay the service cost as specified in the quotation. If such payment is not made within specified period of time, the Service Receiver’s user account is deemed as being the lapse of the period of prescription. Such user account ended due to the lapse, it may be suspended for the Service and the Service Receiver is still bound to pay the service fees.
7. In the event that the Service Receiver fails to pay service fees as previously agreed, the Service Provider has the right to suspend the Service with no advance notification.
8. The Service Provider has the right to deny the Service Receiver’s request to subscribe herein and still exercise his right to withdraw subscribers who violate or attempt to violate the conditions, rules, and regulations of the Service without advance notification. In the event that the Service Provider removes those who are the subscribers herein, the deposit or security or any amount of money will be forfeited at once.
9. In case, the Service Receiver desires to cancel the Service, it is required to give the Service Provider prior written notification at least 7 days. When both the Service Provider and the Service Receiver or either of the party cancels the Service, it shall be deemed as being terminated.
10. When the Service is terminated, the Service Provider has the right to remove or delete all or any portion of the content and information of the Service Receiver contained herein at once.
11. The Service Receiver agrees to comply with conditions, rules, regulations and advices provided by the Service Provider, in a manner consistent with both present and future Policies. In case of infringement thereof, the Service Provider has the right to discontinue the Service immediately.
12. The Service Receiver is required to enter and follow the updated Service herein provided the Service Provider at least once a month for the special promotion or benefit informed therein.
13. If the Quota to use areas herein made available is over or the Service is ended in any way, the Service Provider reserves the right to suspend the Service without advance notification. The Service Provider also has the right to change, alter or modify packages or promotions provided herein without advance notification.
14 In case of any dispute occurred, the Service Receiver concerning and the Service Provider have to cooperate or assist in any way as much as possible with officials to conduct an investigation on criminal matters or damages derived from the Service.
15. The Service Provider reserves the right to prohibit the Service Receiver to reproduce, duplicate, copy or exploit any content and layout/design created by The Service Provider.
16. The Service Provider reserves the right to change the Terms from time-to-time without notice.
These terms and conditions are effective immediately when the Service Receiver makes a decision or opens to use the Service necessarily based on information in the system of Fast Commerz. As the aforementioned, it is considered that the Service Receiver accepts to abide by all provisions herein. At the same time, the Service Provider has the right to refuse and/or cancel the Service to the Service Receiver without advance notification. In addition, the Service Provider reserves the right to terminate the terms and conditions without returning any paid service cost if the Service Receiver does not comply with the Policies and the terms with regard to the above mentioned Service. If any dispute happens, the decision rendered by the Service Provider is deemed final and the Service Receiver has to pay for any legal proceeding expenses instead of the Service Provider.
